Is modafinil legal in Europe?

Not in Poland, Germany, the Netherlands, France, Spain, Italy or Czechia. We searched each country's statutory lists directly and checked the extraction against substances we knew were scheduled. France is worth a footnote: modafinil is on liste I of the substances vénéneuses, which is a control regime in its own right even though it is not the narcotics list — article L.5132-6 of the code de la santé publique conditions importation, possession and acquisition.

In none of the seven countries is that a lawful route for a private person, and the rules do not distinguish between parcels from inside and outside the EU. The mechanisms differ — a distance-selling ban in Spain and Poland, an import prohibition in Germany and the Netherlands, an authorisation regime in France, a physician-led import procedure in Italy — but the outcome for someone ordering from a shop is the same.

Every country we checked allows it for personal use. Germany and France put the figure at three months, Spain at three months with a prescription or medical report, Poland at five smallest packages for therapeutic need. The Netherlands and Czechia publish no figure at all, so we do not invent one. Because modafinil is not scheduled, the narcotics travel paperwork — the Schengen certificate and its equivalents — does not apply to it.

We have not found an official source in any of the seven countries describing what follows for the recipient, so we quote no figures and make no assurances. Germany is the one place with a stated consequence in the statute: an unlawful importation is an administrative offence under § 97 AMG with a maximum fine of €25,000, not a crime.
