Is modafinil legal in Europe?
There is no single European answer, so this page gives seven. We checked the law in Poland, Germany, the Netherlands, France, Spain, Italy and Czechia against national registers, statutes and customs guidance, then had each finding independently challenged before publishing it. Where a source says nothing, we say so rather than filling the gap.
Legal status in seven European countries
In short
- Prescription-only in all seven. The categories differ in name — Rpz, Rp, UR, liste I — but the effect is the same: a pharmacy dispenses it against a prescription.
- A controlled substance in none of them. Modafinil appears on no national narcotics or psychotropics list we searched, so the criminal offences attached to those lists do not reach it.
- Carrying it yourself is permitted everywhere we checked, within limits that differ by country.
- Receiving it by post is not a lawful route for a private person in any of the seven — including from another EU country.

Two distinctions worth keeping straight
The first is between prescription-only and controlled. They are different regimes with different consequences, and conflating them is the most common error written about this subject. Prescription-only governs who may dispense. A narcotics listing attaches criminal offences to possession itself. Modafinil is the former everywhere we looked and the latter nowhere — which is why, in Germany for example, neither the AMG nor the BtMG creates a possession offence for it.
The second is between carrying and receiving. Every country here allows a traveller to bring medicines in for their own use, and several put a figure on it. None of them extends that allowance to a parcel. Poland states the point most directly: the Ministry of Health says the five-package rule covers "osobiste działanie osoby przywożącej" and not consignments ordered from a foreign online pharmacy.
France and Italy each add something the others do not. In France, "neither a narcotic nor a psychotropic" does not mean unregulated — liste I is itself a control regime, and article L.5132-6 conditions importation, possession and acquisition. In Italy, modafinil is on the statutory doping list, and supplying a doping substance outside authorised channels is a criminal offence under article 586-bis of the penal code, which the Constitutional Court confirmed in 2022 requires no sporting purpose.
